1. Who We Are
Sure Insurance and More ("we", "our", or "us") is an independent insurance agency licensed in the state of Florida and in more than 27 U.S. states. We act as intermediaries between individuals, families, and businesses and the licensed insurance carriers with whom we work. Our principal office is located at 8400 Nw 36th St Suite 450 Doral Fl 33166.
This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our website, request a quote, or communicate with one of our advisors. By using our services, you agree to the practices described here.
2. Information We Collect
Depending on the type of coverage you request, we may collect the following categories of personal information:
- Personal identifiers: full name, date of birth, residential address, email address, and phone number.
- Government-issued identifiers: Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN), required by carriers to bind certain policies.
- Financial information: estimated household income and tax-filing status, used exclusively to determine eligibility for ACA/Marketplace subsidies.
- Vehicle information: make, model, year, VIN, and driver's license number, for auto insurance quotes.
- Property information: property address, construction type, and year built, for homeowners or renters insurance quotes.
- Business information: legal business name, EIN, number of employees, and nature of operations, for commercial insurance quotes.
- Health information: health status and coverage history, collected solely to obtain health insurance quotes. This information is treated with the additional protections required under HIPAA (see Section 6).
- Communication records: emails, chat transcripts, and call notes from interactions with our advisors.
- Technical data: IP address, browser type, device, and anonymized browsing patterns collected through our website analytics tools.
We collect information directly from you when you fill out a contact or quote form, speak with an advisor, or provide documents for policy enrollment. We do not purchase contact lists or obtain personal data from data brokers.
3. How We Use Your Information
We use the personal information we collect exclusively for the following purposes:
- To prepare, compare, and deliver personalized insurance quotes.
- To submit applications and bind policies with licensed insurance carriers on your behalf.
- To respond to your inquiries, provide policy support, and handle claims assistance.
- To send you policy renewal reminders, coverage updates, and regulatory notices.
- To send marketing communications about our services, only if you have provided prior express written consent. You may withdraw consent at any time without penalty.
- To comply with applicable federal and state insurance regulations, including reporting obligations to the Florida Department of Financial Services.
- To detect, investigate, and prevent fraud or unauthorized access.
We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.
4. Sharing with Third Parties
We share your personal information only in the following circumstances:
- Insurance carriers and MGAs: We transmit your information to the insurance companies and managing general agents necessary to obtain quotes and bind policies. Each carrier operates under its own privacy policy and applicable insurance regulations.
- Regulatory bodies: We may disclose information to the Florida Department of Financial Services, the National Insurance Producer Registry (NIPR), or other state or federal regulators as required by law.
- Service providers: We use trusted third-party providers for secure email delivery, form processing, and website analytics. These vendors are contractually required to handle your data confidentially and only as directed by us.
- Legal obligations: We may disclose your information when required by a valid court order, subpoena, or applicable law.
We do not sell, rent, or trade your personal information to any third party for commercial purposes.
5. Financial Privacy Rights — Gramm-Leach-Bliley Act (GLBA)
As an insurance agency, we are a financial institution subject to the federal Gramm-Leach-Bliley Act (GLBA), 15 U.S.C. §6801 et seq., and the FTC's Privacy of Consumer Financial Information Rule (16 C.F.R. Part 313). This section explains your rights under that law.
What we collect and why
We collect nonpublic personal financial information (NPFI) — such as income, SSN/ITIN, and policy details — to provide you with insurance products and services. The types of NPFI we collect are described in full in Section 2.
With whom we share your information
We share your NPFI with insurance carriers, MGAs, and licensed service providers as described in Section 4. We do not share your NPFI with nonaffiliated third parties for marketing or commercial purposes beyond what is necessary to service your policy.
Your right to opt out
Under the GLBA, you have the right to opt out of certain information sharing with nonaffiliated third parties. Because we limit our sharing to the exceptions permitted by law (such as sharing with carriers to fulfill your request), the GLBA provides that a formal opt-out may not be required. Nevertheless, you may contact us at any time to restrict the use of your information beyond what is strictly necessary to service your insurance needs.
Annual privacy notice
We will provide an annual privacy notice to customers with active policies as required by GLBA §503. This notice may be delivered by email, mail, or posted on our website. If our information-sharing practices qualify for the "limited sharing" exception under 16 C.F.R. §313.14–§313.15, we will notify you of any change before implementing it.
6. Health Information and HIPAA
When you request a health insurance quote or enroll in a health plan, we may collect and transmit protected health information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA), 45 C.F.R. Parts 160 and 164. In our role as a licensed insurance producer, we may act as a Business Associate with respect to Covered Entities (such as health insurers and the federal Marketplace), and we handle health-related data in compliance with HIPAA Privacy and Security Rules.
Health information is used solely to obtain quotes and enroll you in a health plan. It is never shared for marketing purposes or with parties unrelated to your coverage. You have the right to receive a HIPAA Notice of Privacy Practices from the health insurer with whom your policy is placed.
7. Telephone Communications — TCPA
By providing your telephone number and submitting a contact or quote request form on this website, you expressly consent to receive calls and/or text messages from Sure Insurance and More at the number provided, including calls or texts placed using an automatic telephone dialing system or prerecorded voice, for the purpose of following up on your insurance inquiry. Standard message and data rates may apply.
Consent is not a condition of purchase. You may obtain insurance services without providing telephone consent by contacting us directly by email.
To revoke your telephone consent at any time, reply STOP to any text message we send you, or contact us using the information in Section 15. Revocation of consent will not affect any prior communications made in reliance on your original consent.
8. ACA Health Insurance Marketplace and CMS
When we assist you in enrolling in a health plan through the Federally Facilitated Marketplace (FFM) or a State-Based Marketplace (SBM), we operate as a licensed agent or broker registered with the Centers for Medicare & Medicaid Services (CMS) under 45 C.F.R. §155.220.
In that context:
- We are authorized by CMS to access and submit your application information through Healthcare.gov or the applicable state marketplace platform.
- Information provided for marketplace enrollment — including household composition, income, immigration status, and Special Enrollment Period documentation — is transmitted to and processed by CMS in accordance with CMS's own privacy policies and the Privacy Act of 1974.
- We do not retain copies of sensitive federal eligibility documents beyond what is necessary to assist with your enrollment.
- Our use of your information for marketplace purposes is governed by the CMS Marketplace Privacy Notice, available at healthcare.gov.
9. Data Security
We implement administrative, technical, and physical safeguards to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These include:
- TLS/HTTPS encryption for all data transmitted through our website.
- Access controls that restrict internal data access to authorized personnel only.
- Secure storage of sensitive documents and minimization of SSN/ITIN retention after policy binding.
- Regular review of our security practices and provider agreements.
In the event of a data breach affecting your personal information, we will notify you within 30 days of determining that a breach occurred, as required under the Florida Information Protection Act (FIPA, §501.171, F.S.) and any other applicable law. Notice will be provided by email or written communication to your last known address.
10. Cookies and Website Analytics
Our website uses cookies and similar technologies. We operate a consent-based cookie system with four categories:
- Necessary: Essential for the site to function. These include session, security, and contact form cookies. They are always active and cannot be disabled.
- Analytics: Help us understand how visitors interact with our site (e.g., page views, session duration) using anonymized data. Only active with your consent.
- Marketing: Allow us to show you relevant content and offers. We do not share data from marketing cookies with third-party ad networks without your explicit consent. Only active with your consent.
- Functional: Remember your preferences (e.g., language selection) to personalize your visit. Only active with your consent.
When you first visit our site, a consent banner will appear. Your choice is stored in your browser's local storage. You can change your cookie preferences at any time by clicking "Manage cookies" in the footer of any page.
You may also configure your browser to reject all cookies; doing so will not affect your ability to request a quote or contact us, though some website features may be limited.
11. Your Rights and Choices
You have the following rights with respect to the personal information we hold about you:
- Access: You may request a copy of the personal information we have collected about you.
- Correction: You may request that we correct inaccurate or incomplete information.
- Deletion: You may request deletion of your personal data, subject to our legal and regulatory retention obligations (see Section 12).
- Opt-out of marketing: You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email we send, or by contacting us directly. Opting out of marketing does not affect service communications related to your active policies.
- Withdraw consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
- GLBA opt-out: You may request that we restrict the sharing of your nonpublic personal financial information as described in Section 5.
To exercise any of these rights, please contact us using the information in Section 15. We will respond within 30 calendar days.
12. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this policy, including ongoing support for active policies, and to comply with applicable legal and regulatory requirements. Insurance records are typically retained for a minimum of five (5) years as required by Florida insurance regulations (Fla. Admin. Code Ann. r. 69B-231). After the applicable retention period, data is securely deleted or anonymized.
13. Minors and Age Requirements
Our services are intended for individuals who are 18 years of age or older, as the ability to enter into an insurance contract requires legal majority in the United States. We do not knowingly collect personal information from individuals under the age of 18.
Additionally, in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §6501 et seq., we do not knowingly collect any personal information from children under the age of 13 through our website. If you believe we have inadvertently received information from a minor under 13, please contact us immediately so we can delete it.
14. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we make material changes — including changes that affect your rights or how we share your information — we will notify you by email at the address on file and update the "Last updated" date at the top of this page at least 30 days before the changes take effect. For non-material updates (such as clarifications), we will update the date without prior notice.
We encourage you to review this policy periodically. If you disagree with any material change, you may contact us to exercise your opt-out or data deletion rights before the change takes effect.
